What you agree to, and what we owe you.
The agreement between you and Capsule Camera Ltd. Twelve clauses, in the plainest English we could manage, and short enough to read before you agree to them.
Version 2.1 replaces the terms of 3 March 2026. What changed: refunds at 7.5 became unconditional for thirty days, and 5.3 now says we pull a frame ourselves if a host will not.

The short version
A summary, not the agreement. It is here so you know what you are agreeing to before you read it. Where the two disagree, clauses 1 to 12 are the ones that count.

You open a film, your guests shoot into it, and nobody sees a frame — including you — until it develops. That is the service.
Clause 1 -
Hosts need an account. Guests never do: a link and a camera is the whole of it, and we intend to keep it that way.
Clause 2 -
Tell people the film exists before you point a camera at them, and pull any frame somebody asks you to pull. If you will not, we will.
Clause 5 -
Your photographs stay yours. Our licence covers storing them, developing the film and handing the roll back. Nothing else.
Clause 6 -
First film free. After that £24 a film or £96 a year, and thirty days to change your mind about either.
Clause 7 -
If we break it, you get your money back. What we cannot do is underwrite the night itself — the phone that died, the guest who forgot.

What Capsule is
- 1.1
Capsule is one shared film for one event. A host opens a film and invites people to it. Every photograph taken goes straight into it, sealed. Nobody sees anything — not the guests, not the host — until it develops at the time the host chose.
- 1.2
These terms are the agreement between you and Capsule Camera Ltd (“Capsule”, “we”, “us”). You accept them by opening a film, by taking a photograph into somebody else’s film, or by paying us for either.
- 1.3
Capsule is not a backup, an archive, or a place to publish. It holds one night and hands it back. Keep your own copy of anything you could not stand to lose; clause 8 says how long films are kept.
Hosts, guests and accounts
- 2.1
A host is whoever starts a film. Hosting needs an account, an email address that works, and being at least 16.
- 2.2
A guest is anyone who opens a film’s link and takes a photograph. Guests make no account and set no password. Where a guest is under 16, the host confirms a parent or guardian is content for them to take part.
- 2.3
Keep your account details to yourself; anything done from your account is treated as done by you. If you think somebody else is in it, write to help@trycapsule.app and we will lock them out the same day.
- 2.4
A film link is a key. Whoever holds it can shoot into that film, so send it to the people you invited and not to a public feed.
Running a film
- 3.1
As host you set the shot count, the seal time and the develop time, and can change any of them while the film is sealed. Raising a guest’s shots is instant. Lowering it does not take back shots already spent.
- 3.2
You can unseal a film early. Every guest is told when you do — the waiting only works if it is the same for everybody.
- 3.3
You can remove any photograph in your film at any time, before or after it develops. It goes from every copy we hold and from downloads that have not happened yet. We cannot reach a copy somebody has already saved.
- 3.4
Co-hosts can invite guests, change shot counts and remove photographs. They cannot delete the film or hand it to somebody else.
Acceptable use
- 4.1
Do not use Capsule for anything unlawful, and do not use it to harass, threaten, impersonate or humiliate anybody.
- 4.2
Never put into a film: sexual images of children, in any form or claimed context; intimate images of an adult who has not agreed to them being shared; material inciting violence; or anything you have no right to share. The first of those we report to the authorities, every time.
- 4.3
Do not go after the seal. No probing for undeveloped frames, no scraping, no automated shooting, no reverse-engineering, and no attempt to reach a film you were not invited to.
- 4.4
One film is for one event. An open-ended public film that anybody can join is not what this is for, and we will close it. Reselling or white-labelling Capsule needs a written agreement from us; clause 12 has the address to ask at.
Other people’s photographs
- 5.1
Everybody in a photograph has a stake in it, whether or not they took it, hosted the film or paid for it.
- 5.2
If you are in a Capsule film you can ask for that frame to be pulled, before it develops or long after. Write to privacy@trycapsule.app with the film name and roughly when it was taken. We pull it, and we do not ask you to justify it.
- 5.3
Hosts must honour a removal request from anyone in their film. Where a host will not, we will.
- 5.4
As a host, tell people the film exists before a camera is pointed at them. A card on the table, a line in the invitation, a sentence at the door. That is the whole obligation.
- 5.5
Photographs taken where people reasonably expect not to be photographed do not belong in a film. You know the rooms.
Who owns the photographs
- 6.1
You do. Every photograph you take stays yours, and nothing here moves your copyright to us or to anybody else.
- 6.2
To run the service we need a licence from you, and it is this narrow: store your photographs, develop them into a film, apply the film stock you or the host chose, and deliver the roll to the people who were in it. It lasts as long as the film does and ends when the film is deleted.
- 6.3
That licence carries no right to sell your photographs, license them to anybody, put them in advertising, publish them, or train any model on them. We have never done any of those things, and this clause is what you can hold us to.
- 6.4
If we ever want to show one of your photographs anywhere — this website, a press piece, a talk — we ask first and take no for an answer.
- 6.5
Anything you send us that is not a photograph — a bug report, a suggestion, an argument about develop times — we may use freely to make Capsule better.
Paying for a film
- 7.1
Your first film is free. No card and no trial clock: 25 guests, 12 shots each, kept for 30 days after it develops.
- 7.2
After that a film is £24, paid once, for one event. It is not a subscription and it does not renew.
- 7.3
All year is £96 a year for unlimited films and unlimited guests. It renews until you cancel; cancelling stops the next payment and touches nothing you have already made.
- 7.4
Prices are in pounds sterling and include VAT where we have to charge it. Payment is taken by our processor — we never see and never store your card number.
- 7.5
Within 30 days of paying, write to help@trycapsule.app and we refund a film or a year in full, used or not, no reason needed. After 30 days we will still read the email; we are just not promising the money.
- 7.6
If a film goes past its guest limit mid-event, we do not stop it. We email you afterwards and settle up. Nobody at a door should be turned away by a paywall.
Availability and support
- 8.1
We try hard to be up when the party is on, and we do not quote a percentage we cannot control. Friday and Saturday evenings are staffed by a person, and maintenance happens at hours that are quiet in the UK and Europe.
- 8.2
Free films are kept for 30 days from the moment they develop, then deleted. Paid films are kept until you delete them.
- 8.3
Support is help@trycapsule.app. We answer within one working day, usually the same one. No phone number, no bot.
- 8.4
If we ever have to close Capsule down, you get at least 60 days’ notice and a way to download every film you are in.
Ending it
- 9.1
You can delete a film, or your account, whenever you like. Deleting a film you host removes it for everyone who was in it. That is a real consequence, so we ask you twice.
- 9.2
We can suspend or close an account that breaks clause 4 or clause 5. Where we can, we say what happened and give you a chance to put it right. Where the breach is one of the things at 4.2, we act first and explain afterwards.
- 9.3
If we close your account for a breach, the film is not refunded. If we close it for any other reason, we refund the part you have not used.
- 9.4
Ending this agreement does not undo what already happened under it. Clause 6, clause 10 and clause 12 carry on applying.
What we are responsible for
- 10.1
We will provide the service with reasonable care and skill. That is a real promise, and English law puts it there whether or not we write it down.
- 10.2
What we cannot promise is the night itself. Phones die, guests forget, somebody leaves the camera in a coat. A film that comes back with four photographs in it is not something we can be liable for.
- 10.3
Where we are liable, our liability for any one film is capped at what you paid us for that film, or £50 if the film was free.
- 10.4
We are not liable for losses that are not a foreseeable consequence of us breaking these terms: lost profit, a lost contract, or the value you put on the memory.
- 10.5
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything the law does not permit us to limit.
- 10.6
If you use Capsule as a consumer, your statutory rights sit on top of this clause and are untouched by it.
Changes to these terms
- 11.1
We change these terms when the product changes or the law does. Every version is dated; the date at the top of this page is the one in force.
- 11.2
For a change that materially affects you, we email every host at least 30 days before it takes effect. Small corrections — a typo, a clearer sentence, a new address — go in when we notice them.
- 11.3
If you do not want a change, stop using Capsule before it takes effect and ask us to refund anything paid for a film that has not happened yet.
- 11.4
We do not apply changes backwards. Whatever was true when you bought a film stays true for that film.
Law, disputes and how to reach us
- 12.1
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you live in Scotland or Northern Ireland you may use your own courts, and a consumer anywhere keeps the rights their own law gives them.
- 12.2
Before anybody involves a court, write to us. Most things that arrive looking like a dispute are a misunderstanding about a develop time.
- 12.3
If a clause here is unenforceable, the rest of it stands. This agreement is between you and us, and nobody else can enforce it.

Read it with the other one
The two are written to be read together. This one is the agreement; that one is what happens to the photographs and the data around them.
